OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees.  a.  On or about October 16, 2017, at the site located at 201 Courtright East Road, Pickerington, Ohio, employees were installing a second story window on a two story apartment building while working from a platform elevated by a rough terrain forklift at approximately 12 feet in height with no fall protection, thereby exposing the employees to a fall hazard.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.  a.  On or about October 16, 2017, 2017, at the site located at 201 Courtright East Road, Pickerington, Ohio, employees were performing framing work on a two story apartment building while standing on the second story floor level at approximately 10 feet in height with no fall protection, thereby exposing the employees to a fall hazard.  Duran Lopez Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 976934, citation number 2, item number 1 and was affirmed as a final order on July 14, 2015, with respect to a workplace located at 5001 Olentangy River Road, Columbus, Ohio 43214.  Duran Lopez Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 808781, citation number 1, item number 1 and was affirmed as a final order on March 8, 2013, with respect to a workplace located at Thompson Road and Chestnut Hill Drive, Columbus, Ohio 43230.
