OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falls from fiberglass step ladders. Side loading was permitted by the employer prohibited by ANSI A14.5-2000. United Rentals, Inc. dba United Rental Trench Safety Division: On or about May 14, 2014; a temporary agency employee of United Rentals, Inc. fell from a Bauer Type II Fiberglass 10 foot step ladder while assembling a Speed Shore Trench Shield. The ladder was used incorrectly in that it was not placed so that the employee working from the ladder would not have had to place his body outside of the side /middle of the ladder causing the employee to lose his balance when the wall of the Trench Shield tilted towards the employee. The employee suffered a broken right arm, shattered right elbow and damaged radial nerve from the fall. AMONG OTHER METHODS, FEASIBLE AND ACCEPTABLE METHODS TO CORRECT THIS HAZARD ARE: 1. Ensure that proper training is provided to all employees including those hired through temporary agencies on step ladder safety. According to ANSI A14.5-2000/ 9.1.5- Proper use of a ladder will contribute significantly to safety. Factors contributing to falls include: haste, sudden movements, lack of attention during use, ladder condition (worn or damaged), users age or physical condition, or both, and the users foot wear. 2. Ensure that proper use is enforced by proper supervision to ensure that employees do not side load. ANSI A14.5-2000 / 9.3.6- Portable ladders are not designed for excessive side loading, and such abuse of the ladder shall be avoided. The ladder shall be kept close to the work. The user shall not overreach, but shall descend and relocated the ladder instead. When using a ladder, the user shall never push or pull unless the ladder is properly secured.
