29 CFR 1910.132(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, shall be provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact. WORKPLACE: The employee, required to work with hazardous chemicals, such as (but not limited to) Tire Buster, Citrus Suds, Flash Break (Yellow, Red & Blue) polish, Lighting Alkaline detergent, Re-Solv Lo-foaming acidic detergent, Platinum PCW81 Purple wheel cleaner, Desert-Dri, and Simoniz Kleen Green was not provided with the appropriate types of personal protective equipment (PPE).

The employer shall record the annual maintenance date and retain this record for one year after the last entry or the life of the shell, whichever is less. The record shall be available to the Assistant Secretary upon request. WORKPLACE: The employer did not perform an annual maintenance check on the Kidde 5lb ABC dry chemical fire extinguisher.
