29 CFR 1926.501(b)(15): "Walking/working surfaces not otherwise addressed." Except as provided in 1926.500(a)(2) or in 1926.501 (b)(1) through (b)(14), each employee on a walking/working surface 6 feet (1.8 m) or more above lower levels shall be protected from falling by a guardrail system, safety net system, or personal fall arrest system.   a.  On May 16, 2014, at the communication tower construction site located at 15826 US 33, Nelsonville, Ohio, employees were climbing a 290 foot self-supporting communication tower without the use of fall protection thereby, exposing the employees to a fall hazard.

29 CFR 1926.503(c)(3): "Retraining." When the employer has reason to believe that any affected employee who has already been trained does not have the understanding and skill required by paragraph (a) of this section, the employer shall retrain each such employee. Circumstances where retraining is required include, but are not limited to, situations where:  Inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicate that the employee has not retained the requisite understanding or skill.  a. At the communication tower construction site located at 15826 US 33, Nelsonville, Ohio, the employer did not retrain employees when there was reason to believe there were inadequacies in the requisite understanding of fall protection systems.
