29 CFR 1910.141(a)(5): Vermin control. Every enclosed workplace shall be so constructed, equipped, and maintained, so far as reasonably practicable, as to prevent the entrance or harborage of rodents, insects, and other vermin. A continuing and effective extermination program shall be instituted where their presence is detected. a. At the work site, employees worked in a warehouse where materials were stored while awaiting delivery or pick up. Loose insulation in half of the ceiling had allowed a large number of birds to live, nest and rear young. The birds deposited droppings on the employees, floor, walls, pipes, support beams, cargo, racking overhead doors, fork lift trucks, heaters, insulation and equipment. The employer did not have a program for exterminating the birds and/or preventing their re-entry into the work site.
