OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees.  On or about 5/19/14, at the Duluth facility, employees were exposed to struck by hazards as the employer was not following standards set forth in ANSI MH16.1, 2008 Specification for the Design, Testing and Utilization of Industrial Steel Storage Racks for metal shelving systems used in production departments. The employer did not display the load ratings on the racks.   In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1910.101(b): The in-plant handling, storage, and utilization of all compressed gases in cylinders, portable tanks, rail tank cars, or motor vehicle cargo tanks were not in accordance with Compressed Gas Association Pamphlet P-1-1965, which is incorporated by reference as specified in CFR 1910.6.  On or about 5/19/14, at the Duluth facility, employees were exposed to struck by hazards as propane tanks that were removed from powered industrial trucks were stored just outside an emergency exit door at the top of a set of stairs leading outside instead of inside the provided tank storage rack.   In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1910.151(c): Where employees were exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body were not provided within the work area for immediate emergency use.  On or about 5/19/14, at the Duluth facility, employees were exposed to corrosive materials and were not provided an eye wash. Instances included:  1 - At the battery charging area in warehouse facility - the eye wash had a hole and was empty 2 - Near front warehouse offices where water is added to battery cells - no eye wash is provided  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1910.303(g)(2)(i): Except as elsewhere required or permitted by Subpart S of Part 1910, live parts of electric equipment operating  at 50 volts or more were not guarded against accidental contact by use of approved cabinets or other forms of approved enclosures or by any of the means identified in paragraphs (A), (B), (C), and (D) of 29 CFR 1910.303(g)(2)(i).  On or about 5/19/14, at the Duluth job site, in the pack out area, employees were exposed to electrical shock hazards as the pack out conveyor had an electrical box that had been knocked off the motor to which it had been attached exposing inner conductors.    No abatement certification or documentation is required for this item.
