OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees. On or about 5/19/14, at the Duluth facility, employees were exposed to struck by hazards as the employer was not following standards set forth in ANSI MH16.1, 2008 Specification for the Design, Testing and Utilization of Industrial Steel Storage Racks for metal shelving systems used in production departments. The employer did not display the load ratings on the racks. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

On or about 5/19/14, at the Duluth facility, employees were exposed to struck by hazards as propane tanks that were removed from powered industrial trucks were stored just outside an emergency exit door at the top of a set of stairs leading outside instead of inside the provided tank storage rack. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
