29 CFR 1926.300(b)(4)(ii): The point of operation of machine(s) whose operation exposed an employee to injury was not guarded.  The employer does not guard all the rotating parts of machines to protect the operator and other employees in the construction area.  This violation was observed on or about May 19, 2014, on the construction site where an employee was exposed to struck-by and caught-by hazards when operating a Makita brand circular saw without a guard.     Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that all machines that have exposed rotating parts are guarded.

29 CFR 1926.416(e)(1): Worn or frayed electric cords or cables were used.  The employer does not ensure all worn or frayed electrical cords or cables are not used.  This violation was observed on or about May 19, 2014, in the entry area of the residential building, where an employee was exposed to an electrical hazard while using a Makita brand circular saw with a worn electrical cord.    Pursuant to 29 C.F.R. 1903.19, within 10 (ten) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that worn or frayed electric cords or cables are not used.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b).  The employer does not ensure that employees engaged in residential construction activities 6 feet or more above lower levels were protected by a fall protection system.  This violation occurred on or about May 19, 2014 employees were exposed to a fall hazard of more than 6 feet while doing framing work on the second level of a residential building being constructed without a fall protection system.  Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure employees engaged in residential construction activities at heights of six feet or more are protected from falling.

29 CFR 1926.1051(a): Stairway(s) or ladder(s) were not provided at all personnel points of access where there was a break in elevation of 19 inches (48 cm) or more, or no ramp, runway, sloped embankment, or personnel hoist was provided.  The employer does not provide proper access to the employees where there is a break in elevation of 19 inches or more. This violation was observed at the construction site on May 19, 2014 where employees were exposed to a 20 ft. fall hazard when employees were ascending and descending the roof of a residential construction using the frame of the structure.   Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees are provide with adequate access where there is a break in elevation of 19 inches or more.
