OSH ACT of 1970: Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing hazards: Warehouse: On, or about, May 21, 2014, employees operating the Baker forktruck and Eaton forktruck #94 were not wearing the seat belts provided. The seat belt on Eaton forktruck #94 was wound into the vertical support members for the operators seat.
