29 CFR 1910.132(b): Where employees provide their own protective equipment, the employer did not assure its adequacy, including proper maintenance and sanitation of such equipment. (a) The employer did not assure that employee-owned equipment, such as tight fitting face piece respirators, provided adequate protection for dust and welding fume exposures those employees encountered in the workplace. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR 1910.134(c)(2)(ii): The employer did not establish and implement those elements of a written program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use does not present a health hazard to the user: (a) The employer did not have a respiratory protection program and allowed employees to use their own respirators, such as tight fitting face piece respirators, on a voluntary basis while performing job tasks such as grinding and welding to repair steel truck bodies. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR 1910.134(k)(6): The employer did not provide the basic advisory information on respirators, as presented in Appendix D of 29 CFR 1910.134, in written or oral format to employees who wear respirators when such use was not required by the employer: (a) The employer provided 3M 8210 N95 dust mask respirators for voluntary use, but did not provide employees with the required information contained in Appendix D of the standard.
