29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them): (a)Squire Village Apartments - Carpentry Work: On or about May 7, 2014, the employer failed to maintain a safety program which provided for regular inspections of jobsites, materials and equipment to be made by a competent person. Unsafe equipment being used at the time of the inspection included an unmounted, metallic, quad, electrical receptacle box which energized a deWalt air compressor which was used to power pneumatic air guns.

29 CFR 1926.403(b)(2): Listed, labeled, or certified equipment was not installed and used in accordance with instructions included in the listing, labeling, or certification: (a)Squire Village Apartments - Utility Carpentry work: On or about May 7, 2014, an unmounted, metallic, quad, electrical receptacle box which energized a deWalt air compressor was used to power pneumatic air guns. The receptacle was laying on ground exposing employees to electric shock hazards.
