On or about May 21, 2014 located along a side area of the structure a Genie GTH644 rough terrain forklift was being operated in an area where the operator did not ensure pedestrians were safeguarded in that a clear path of travel was not maintained for an employee/pedestrian positioned between the front and rear tire travel area of the forklift prior to the operator beginning to travel forward with the forklift.

On or about May 21, 2014 and prior to that time located along various areas of the site prior to ensuring forklift operator(s) had completed the training requirements of Subpart N, paragraph (l) in 29CFR 1910.178 as adopted by 29CFR 1926.602(d) the employer permitted an employee not involved in a training operation operated a Genie GHT644 rough terrain forklift to raise and transport purlins on the jobsite and operators to operate the forklift who had not been trained on the operating instructions, warnings or precautions of the Genie GTH644 operators manual.
