29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:        a) On or about 05/22/14, on construction site,  Apartment  Building  at Oxford Village Townhomes,  19 -27  Longmeadow Road , Amherst , NY:   Employees  engaged in construction work including roofing & clean-up  were not trained to recognize potential hazards on this type of jobsite,  including but not limited to falls from roofs, ladders, skylights,  stairs & scaffolds, electrical hazards, unguarded tools/machines, fire hazards, and the need for personal protective equipment to protect them from various hazards. They  also were not trained in the applicable OSHA regulations to control or eliminate these hazards.    ABATEMENT CERTIFICATION REQUIRED

The Saw  was connected to 120 volt-ac power  via an extension  cord which was plugged into a  receptacle on a Coleman Powermate 5000 portable generator. The plug on the extension cord lacked a ground prong.       NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.416(e)(1): Worn or frayed electric cords or cables were used:    a) On or about 05/22/14, on the roof construction site of Apartment  Building  at Oxford Village Townhomes,  19 -27  Longmeadow Road , Amherst , NY:  An employee used a Ryobi circular saw  to cut plywood.  The Saw  was connected to 120 volt-ac power via an extension  cord which was plugged into a  receptacle on a Coleman Powermate 5000 portable generator. The outer sheath of  the  extension cord  was frayed at the female end, exposing the conductors.    NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.451(g)(1)(i): Each employee on a boatswains' chair, catenary scaffold, float scaffold, needle beam scaffold, or ladder jack scaffold was not protected by a personal fall arrest system:      a) On or about 05/22/14, on the roof construction site, Apartment  Building  at Oxford Village Townhomes,  19 -27 Longmeadow Road, Amherst, NY: Two ladder jack scaffolds were erected on the north side of the Building. Employees were on the "pick" of each scaffold installing roofing shingles and transporting bundles of the shingles to employees on the roof. The employees were exposed to a fall of approx. 17 ft. to the ground. No personal fall arrest system or other fall protection system was utilized.        NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladders' length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:     a) On or about 05/22/14, on the roof of Apartment Building at Oxford Village Townhomes, 19 -27 Longmeadow Road, Amherst, NY: Two ladder jack scaffolds were erected on the north side of the Building. Employees used an extension ladder to access the "pick" of each scaffold. The employees were exposed to a fall of approx. 17 ft. to the ground because the siderails of an extension ladder used to access the west scaffold from the ground only extended approx. 16 inches above the edge of the pick, and the siderails of an extension ladder used to access the east scaffold from the ground only extended 27 inches above the edge of the pick.    NO ABATEMENT CERTIFICATION REQUIRED
