OSH ACT of 1970 Section (5)(a)(1): The employer does not furnish to each of his employees employment and a place of employment which are free from the recognized hazards falling which is causing or likely to cause death or serious physical harm to employees in that elevated employees were exposed to falls from an unmanned fork lift.       This violation occurred on or about May 22, 2014, at the job site where employees were exposed to a fall hazard when working from the platform of an elevated forklift that did not have an operator in position to control the unit, or operate the controls.         Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that when elevating personnel, a trained operator is in position to control the truck of available to operate the controls.

29 CFR 1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section:     The employer does not protect each employee working on a scaffold more than 10 feet above a lower level from falling.  This violation was observed on or about May 22, 2014, at the job site where an employee was exposed to a fall hazard when working from a platform being lifted by a fork lift without being protected from falling.       Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that each employee working on a scaffold more than 10 feet above a lower level is protected from falling.

29 CFR 1926.602(c)(1)(viii)(A): The industrial truck was not equipped with a safety platform/cage firmly secured to the lifting carriage and/or forks when used for lifting personnel:     The employer does not firmly secure the work platform to the forks of the fork lift.  This violation was observed on or about May 22, 2014, at the job site near the where an employee was exposed to a fall hazard when working from an elevated platform on the forks of a fork lift without the platform being firmly secured to the forks.        Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that all work platforms are firmly attached to the forks of forklifts.

29 CFR 1926.602(c)(1)(ii): Modifications or additions which affect the capacity or safe operation of the equipment were made without the manufacturer's written approval:   The employer uses fork lift forks that have been modified that affect the capacity and safe operation without the manufacturer's written approval. This violation was observed on or about May 22, 2014, when an employee was working from an elevated platform being lifted by a fork that had a hole cut into it without having this modification approved by the manufacturer.     Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that all modifications made to powered industrial trucks, that can affect the capacity and safe operation, are approved in writing by the manufacturer.
