OSH ACT of 1970 Section (5)(a)(1):  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of being struck by fragments of Polyvinyl Chloride (PVC) plastic pipe in the event that the PVC plastic pipe ruptured:    a)Entire facility; On or about May 27, 2014 and at times prior, the employer exposed his employees to the hazard of being struck by fragments of Polyvinyl Chloride (PVC) plastic pipe in the event that the PVC plastic pipe ruptured. PVC plastic piping was used in exposed above ground locations to transport compressed air at 120 psi. The employer failed to follow ASME Gas Transmission and Distribution Piping Systems - ASME Code for Pressure Piping, B31. Section 842.3.3 Installation Provisions which prohibits the above ground use of PVC pipe for compressed air conveyance.

29 CFR 1910.253(b)(2)(ii): Assigned storage spaces for cylinders was not located away from elevators, stairs, or gangways where cylinders could not be knocked over or damaged by passing or falling objects, or subject to tampering by unauthorized persons:   a) South wall, shop area; on or about May 27, 2014 and times prior the employer allowed oxygen-fuel cylinders to be stored without constraints to prevent oxygen-fuel cylinders from being knocked over.

29 CFR 1910.253(b)(2)(iv): Valve protection caps, where cylinders were designed to accept caps, were not always in place, hand-tight, except when cylinders were in use or connected for use:  a) South wall, shop area; on or about May 27, 2014 and times prior the employer allowed oxygen-fuel cylinders to be stored without valve caps to prevent valves from being broken off in the event cylinders are knocked over.
