29 CFR 1910.134(c)(2)(i): The employer did not determine if the voluntary use of a respirator did not in itself create a hazard. Note:  Failure to provide voluntary respirator users with a copy of Appendix D should be cited under 29 CFR 1910.134(k)(6).   On or about May 28th 2014, at the above addressed jobsite the employer did not provide the information contained in the appendix D to employees using a 3M 8211 N95 filtering face-piece respirator in the fabrication and painting areas.

29 CFR 1910.138(b): The employer did not base selection of appropriate hand protection on an evaluation of the performance characteristics of the hand protection relative to the tasks to be performed, conditions present, duration of use, and the hazards and potential hazards identified: Methyl Methacrylate.   On or about May 28th 2014, at the above addressed jobsite, the employer did not provide the appropriate gloves (Nitrile) to the employees who were wearing latex examination gloves when performing Methyl Methacrylate operations.

29 CFR 1910.1200(h)(3)(iv):   The details of the hazard communication program developed by the employer, did not include an explanation of the labels received on shipped containers and the workplace labeling system used by their employer; the safety data sheet, including the order of information and how employee could obtain and use the appropriate hazard information:  On or about May 28th 2014, at the above addressed jobsite, the employer did not provide adequate training or information regarding the hazards of chemicals, according with the Globally Harmonized System of Classification and Labeling of Chemicals with pictograms or representations as a part of the new SDS  and label format.
