29 CFR 1926.502(d)(16)(ii): 29 CFR 1926.502 (d)(16)(ii): Personal fall arrest systems, when stopping a fall, did not limit the maximum arresting force on an employee to 1800 pounds (8kn) when used with a body harness:     On or about May 28, 2014, an employee was using a personal fall arrest system that would not limit the maximum arresting force on an employee to less then 1800 pounds.       ABATEMENT DOCUMENTATION IS REQUIRED FOR THIS ITEM IN ACCORDANCE WITH REQUIREMENTS OF 29 CFR 1903.19(D).

29 CFR 1926.502(d)(16)(iii): Personal fall arrest systems, when stopping a fall, were not rigged such that an employee could not free fall more than 6 feet (1.8 m) nor contact any lower level:      On or about May 28, 2014, an employee was using a personal fall arrest system that was rigged so an employee could free fall greater than 6 feet.      ABATEMENT DOCUMENTATION IS REQUIRED FOR THIS ITEM IN ACCORDANCE WITH REQUIREMENTS OF 29 CFR 1903.19(D).

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.  Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.     On or about May 28, 2014, employees were engaged in residential roofing activities at a height greater than 6 feet with no fall protection.       Diaz Roofing, was previously cited for a violation of this Occupational Safety and Health Standard 29 CFR 1926.501(b)(13) which was contained in OSHA Inspection Number 659858, Citation Number 01, Item Number 01, Issued November 15, 2012, and was affirmed as final order on November 27, 2012, with respect to a workplace located at 130 Division Street, Madison, WI 53711.   Diaz Roofing, was previously cited for a violation of this Occupational Safety and Health Standard 29 CFR 1926.501(b)(13) which was contained in OSHA Inspection Number 313137929, Citation Number 01, Item Number 01, Issued July 28, 2011, and was affirmed as final order on August 9,  2011, with respect to a workplace located at Town Hall Road, Sun Prairie, WI 53590.  Diaz Roofing, was previously cited for a violation of this Occupational Safety and Health Standard 29 CFR 1926.501(b)(13) which was contained in OSHA Inspection Number 313134215, Citation Number 01, Item Number 01, Issued December 8, 2010, and was affirmed as final order on December 27, 2010, with respect to a workplace located at 1619 Center Street, Black Earth, WI 53515.  Diaz Roofing, was previously cited for a violation of this Occupational Safety and Health Standard 29 CFR 1926.501(b)(13) which was contained in OSHA Inspection Number 313139322, Citation Number 02, Item Number 02, Issued August 8, 2009, and was affirmed as final order on August 20,  2009, with respect to a workplace located at 109 Main Street, Monticello.   ABATEMENT DOCUMENTATION IS REQUIRED FOR THIS ITEM IN ACCORDANCE WITH REQUIREMENTS OF 29 CFR 1903.19(D).
