29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: a) Rail Maintenance laborer: On or about May 30, 2014 and at times prior thereto the employer exposed the employee to noise levels of 121.3% (equivalent to an 8 hour time weighted average (TWA) of 91.3 dBA) which is 2.426 times the Action Level of 50% (equivalent to an 8 hour TWA of 85 dBA) while blowing dust inside rail cars. Results were calculated for 196 minutes sampling period. The employer did not administer a continuing, effective hearing conservation program. b) Rail Maintenance laborer: On or about May 30, 2014 and at times prior thereto the employer exposed the employee to noise levels of 130.8% (equivalent to an 8 hour time weighted average (TWA) of 91.9 dBA) which is 2.616 times the Action Level of 50% (equivalent to an 8 hour TWA of 85 dBA) while blowing dust inside rail cars. Results were calculated for 202 minutes sampling period. The employer did not administer a continuing, effective hearing conservation program. Global Auto Processing Services was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.95(c)(1), which was contained in OSHA inspection number 312777923, citation number 1, item number 1 and was affirmed as a final order on January 26, 2011, with respect to a workplace located at 2000 Webb Road West Point, GA 31833.
