OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employee(s) in that employee(s) were exposed to the hazard described below:   In the middle of Bates Street (in front of address 3831 Bates Street), on or about 05/09/2014, the employer failed to provide adequate signage and traffic cones needed for work in the center of a road with low traffic volumes, exposing employees to a potential struck-by hazard from oncoming traffic (two lane traffic, one lane for each direction.)

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems.   A) In the roadway in front of address 3831 Bates Street, St. Louis, MO, an excavation was dug in the middle of Bates Street on or about 05/09/2014 without an adequate inspection completed by a competent person, resulting in the failure to correct the following hazards prior to authorizing employee entry:  * Lack of safe access/ egress for the excavation (no ladder/ stairs were present) * Lack of shoring/ shielding for the excavation (soil classified as class B due to prior disturbance) * Lack of head protection or sufficient removal of asphalt (excavation was undercut and exposed employees to collapsing roadway sections)

The employer had not complied with the provisions of 29 CFR 1926.652(b)(1)(i).  In the middle of Bates Street (in front of address 3831 Bates Street), on or about 05/09/2014, an employee was exposed to a caught between hazard when he was working in an area of an excavation greater than five feet in depth without any means of shoring/ shielding protection.
