29 CFR 1926.451(b)(1): Platform(s) on all working levels of scaffolds, were not fully planked or decked between the front uprights and guardrail supports such that the space between adjacent units, and the space between the platform and the upright supports:   (a) At the Burger King on North Morley in Moberly, Missouri on or about May 30, 2014 workers were working from two sets of scaffold.  The scaffold decks were not fully planked between the upright supports leaving spaces as wide as 20 inches.

29 CFR 1926.451(b)(2): Except as provided in paragraphs (b)(2)(i) and (b)(2)(ii) of this section, each scaffold platform and/or walkway was not at least 18 inches (46 cm) wide:  (a) At the Burger King in Moberly, Missouri on or about May 30, 2014 the scaffold platform being used on the south side of the restaurant was only 11 1/2 inches in width.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, sturcure, personnel hoist, or similar surface was not used:  (a) At Burger King in Moberly, Missouri on or about May 30, 2014 employees of Lucas Stone and Brick LLC climbed the scaffold frame and the building framing to get to and from the scaffold deck.

29 CFR 1926.1051(a): Stairway(s) or ladder(s) were not provided at all personnel points of access where there was a break in elevation of 19 inches (48 cm) or more, or no ramp, runway, sloped embankment, or personnel hoist was provided:  (a) At the Burger King in Moberly, Missouri on or about May 30, 2014 Lucas Stucco had workers working from scaffolding that was 8 and 10 feet from the ground and ladders were not provided and no other safe means of egress was available.  (b) At the Burger King in Moberly, Missouri on or about May 30, 2014 Lucas Stucco had workers working from the roof of the restaurant and the workers were climbing onto the scaffold and then onto the framing of the overhang of the building to egress the roof.  NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM.  FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.501(b)(4)(ii): Each employee on a walking/working surface was not protected from tripping in or stepping into or through holes (including skylights) by covers:  (a) At the Burger King restaurant remodeling site in Moberly, Missouri a hole 2 feet deep and 3 feet square was not protected to prevent workers from accidently stepping into the hole.  (b) At the Burger King restaurant remodeling site in Moberly, Missouri short lengths of re-bar and a concrete block were laying next to a hole that could cause a worker to trip and step or fall into a hole.
