29 CFR 1926.651(j)(2): Employees were not protected from excavated or other materials or equipment that could pose a hazard by falling or rolling into excavations, or by a combination of both if necessary: The employer does not protect employees from excavated or other materials that could pose a hazard by falling or rolling into excavations. This violation occurred on or about May 23, 2014, at the excavation site, segment 9, where an employee was exposed to a struck-by hazard when working in an excavation without retaining devices that are sufficient to protect employees from excavated or other materials that could pose a hazard by falling or rolling into excavations. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees are protected from excavated or other materials that pose a hazard by falling or rolling into excavations.
