OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to the hazard of being struck by. a) Intersection of 9th Ave. & West 48th st: Employer did not ensure that the blade flange bolt was tightened securely to approximately 77 lb.ft. as per manufacturer's instructions. The blade flange bolt was loosed during operation of the concrete saw, and the rotating saw blade was ejected from the machine. Employees were exposed to being struck by the ejected rotating saw blade. On or about 05/28/14.

29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury. a) Jobsite: The employer did not instruct each employee in the recognition and avoidance of unsafe conditions applicable to his work using concrete saws on site, including but not limited to: did not instruct employees to tighten the blade flange bolt to a torque required by the manufacturer. On or about 05/28/14. NOTE: IN ADDITION TO CERTIFICATION OF ABATEMENT, THE EMPLOYER IS REQUIRED TO SUBMIT DOCUMENTATION OF ABATEMENT FOR THIS ITEM. FAILURE TO COMPLY MAY RESULT IN AN ADDITIONAL PENALTY OF $1,000 AS PER 29 CFR 1903.19.
