29 CFR 1918.81(a): Drafts were not safely slung before being hoisted. The correcting and/or creating employer does not ensure that drafts were safely slung before being hoisted. This violation occurred on or about May 10, 2014 at the Intermarine terminal, on the Industrial Dawn vessel where Gulf Stream Marine and/or Industrial Dawn employees were exposed to struck-by hazards while a spreader bar being used during a tandem lift of a draft was not safely slung before being hoisted. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that drafts are safely slung before being hoisted.

29 CFR 1918.81(k): The employer shall require that employees stay clear of the area beneath overhead drafts or descending lifting gear. The correcting and/or creating employer does not require employees to stay clear of the area beneath overhead drafts or descending lifting gear. This violation occurred on or about May 10, 2014, at the Intermarine Terminals, on the Industrial Dawn vessel where Gulf Marine employees were exposed to struck-by hazards while placing dunnage beneath an overhead draft as it descended into the cargo hold. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees stay clear from areas beneath overhead drafts or descending lifting gear.
