29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents.     a)  Octagon Rooftop - On or about May 28, 2014, employees were using hand power tools such as pneumatic nail guns, and circular saws without the use of safety glasses, while another employee was in close proximity without eye protection, exposing employees to eye injuries from ricocheting and flying debris.        b)  Flat-rooftop installing plywood on parapet wall - On or about May 28, 2014, an employee was using hand power tool such as pneumatic nail gun without the use of safety glasses, exposing employees to eye injuries from ricocheting and flying debris.        ABATEMENT CERTIFICATION IS NOT REQUIRED

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.    a)  Flat-roof area - On or about May 28, 2014, employees working on elevated surface (flat roof) installing plywood on the side of a 21-inch parapet wall near the unguarded edge without adequate fall protection, exposing employees to a fall hazard of about 12 feet.       ABATEMENT CERTIFICATON IS REQUIRED

29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system.  Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system.   a) Octagon roof-top  On or about May 28, 2014, employees were allowed to work on a 8 sided 4-in-12 pitch roof installing ply-wood sheathing, and felt paper without fall protection on the exposed sides over the flat roof, exposing employees to a fall hazard up to 7 feet 8 inches.      ABATEMENT CERTIFICATION IS REQUIRED

29 CFR 1926.602(d): The employer did not certify that each operator had been trained and evaluated as required by paragraph 29 CFR 1910.178(l): As referenced in 29 CFR 1926.178 (l) (3) (i), 29 CFR 1926.178 (l) (4) and 29 CFR 1910.178  a) Throughout jobsite - On or about, and at times prior to May 28, 2014, the employer did not ensure employees who were allowed to operate a Caterpillar TH63, Telehandler (Rough Terrain) Forklift S/N 5WM04642,  were certified and had been evaluated in accordance the standards relating to safe forklift operation, exposing employees to forklift accidents such as ejection, and struck-by hazards.      ABATEMENT CERTIFICATION IS REQUIRED
