OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by lightning during thunderstorms:    a)  On or about May 29, 2014, at the above addressed job site, employees were exposed to the hazard of being struck by lightning while pumping concrete on a roof of a building in the rain.

29 CFR 1926.501(b)(3): Each employee in a hoist area was not protected from falling 6 feet (1.8m) or more to lower levels by guardrail systems or personal fall arrest systems:  a)  On or about June 19, 2014, at 909 S Federal Hwy, Pompano Beach Florida, 33062, an employee who was not protected with a means of conventional fall protection was exposed to a fall hazard while standing at the edge of a roof and hoisting materials in a bucket with the use of a line.
