29 CFR 1910.134(h)(1): Respirators were not cleaned and disinfected using the procedures in Appendix B-2 of 29 CFR 1910.134 or equivalent procedures recommended by the respirator manufacturer: (Construction Reference 1926.103) (a) Euro Castle Construction employees working at 430 W 15th St. New York, NY 10017, were allowed voluntary respirator use, the respirators were use for grinding bricks and restoring the building's facade; but the respirators (3m, North, MSA)were not maintain clean. The condition was noted on or about May 29, 2014. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 AS PER 29 CFR 1903.19

The condition was noted on or about May 29, 2014. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 AS PER 29 CFR 1903.19

The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: Note: The employer may discontinue an employee's medical evaluations when the employee is no longer required to use a respirator. (a) Euro Castle Construction employees working at 430 W 15th St. New York, NY 10017, were allowed voluntary respirator use (half face tight fitting 3M, MSA and North) for grinding and repointing bricks; however medical evaluation was not provided until after the opening conference. The condition was noted on or about May 29, 2014. NOTE: BECAUSE ABATEMENT OF THIS VIOLATION IS ALREADY DOCUMENTED IN THE CASEFILE, THE EMPLOYER NEED NOT SUBMIT CERTIFICATION NOR DOCUMENTATION OF ABATEMENT OF THIS VIOLATION AS NORMALLY REQUIRED BY 29 CFR 1903.19.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area: (Construction Reference: 1926.59) (a) Euro Castle Construction employees working at 430 W 15th St. NY, NY. Employees were exposed to hazardous substances including but not limited to silica, lead and Peel Away. The employees removed lead based paint from the facade of the building and also grinded the brick facade. The condition was noted on or around 05/29/14. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 AS PER 29 CFR 1903.19
