29 CFR 1926.300(c): Employees using hand and power tools and exposed to the hazard of falling, flying, abrasive, or splashing objects, or exposed to harmful dusts, fumes, mists, vapors, or gases were not provided with the particular personal protective equipment:   a) On May 7, 2014 and at times prior thereto; rear of building; employees operating a jack-hammer in a trench were not using or provided with the proper personal protective equipment such as but not limited to eye/face protection.

29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary   a) On May 7, 2014 and at times prior thereto; rear of building; the spoil pile was located at the edge of the trench exposing the employees to materials rolling into the trench.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1910.134(c)(2)(i): Respirator users were not provided with the information contained in Appendix D to 29 CFR 1910.134 when the employer determined that any voluntary respirator use was permissible: (Construction Reference 1926.103)  a) On May 7, 2014 and at times prior thereto; rear of building; employees were voluntary wearing N95 respirators without being provided the information in Appendix D.   Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
