29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system: Trench from the Power Distribution Center to the Pump House on the jobsite located at 3381 Road 28 South, Kimball, NE: The employer is failing to protect employees from cave-ins while connecting PVC conduit at an approximate depth of 6 feet inside of the trench. The trench is approximately 45 feet long and varies in depths from 4 feet at the ends and 6 feet in the center. The employer failed to provide trench boxes, hydraulic shoring or implement another approved means of protection such but not limited to sloping or benching of the soil.

29 CFR 1926.1053(b)(4): Ladders were used for purposes other than the purposes for which they were designed: Trench from the Power Distribution Center to the Pump House on the jobsite located at 3381 Road 28 South, Kimball, NE: The employer is failing to protect employees in that step ladders were being used in the folded position as means of egress during trenching/ excavation activities. Two, eight foot fiberglass step ladders were being used inside of a trench for egress during the inspection. ANSI- A14.5-2007: 9.3.1.2- states that self-supporting ladders shall not be used as single ladders or in the partially closed position.
