29 CFR 1926.652(a)(2): Protective systems did not have the capacity to resist without failure all loads that were intended or could reasonably be expected to be applied or transmitted to the system: a) 247 Fairmount Avenue, Chatham, NJ. The shoring system did not have the capacity to resist without failure the load imposed upon it by the excavator picking the loaded debris bucket from the excavation with its tracks adjacent to the wall supports. Violation observed on or about 05/28/2014.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: a) 247 Fairmount Avenue, Chatham, NJ. The ladder used for access out of the North side of the excavation did not have its side rails extend at least 3 feet above the upper surface being accessed exposing workers to an approximate 15 foot fall to the floor of the excavation. Violation observed on or about 05/28/2014.
