29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury: a) Demolition of the Mid-Town Parking Garage, West 9th Street between Shipley & Orange Streets - Employees who were permitted to access areas in close proximity to an unstable second-story wall were exposed to a struck-by hazard posed by a collapsing brick façade. On or about June 4, 2014. Pursuant to 29 CFR 1903.19, the employer must submit abatement certification and documentation, required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

29 CFR 1926.859(g): During demolition, continuing inspections by a competent person were not made as the work progressed to detect hazards resulting from weakened or deteriorated floors, or walls, or loosened material. Employees were permitted to work where such hazards existed: a) Demolition of the Mid-Town Parking Garage, West 9th Street between Shipley & Orange Streets - These inspections were not made to prevent employee access to areas in close proximity to an unstable second-story wall where these employees were exposed to a struck-by hazard posed by a collapsing brick façade.
