29 CFR 1910.178(l)(6): The employer did not certify that each operator had been trained and evaluated as required by paragraph (l) through a certification that included the name of the operator, the date of the training, that date of evaluation, and the identity of the person(s) performing the training or evaluation:    a) 2155 E.  Castor Ave, Philadelphia, PA  The employer did not ensure that each employee operating the Komatsu powered industrial truck was trained and evaluated. This condition exposed the employees to struck-by/caught in-between hazards. This condition was observed on or about May 28, 2014.    Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

Castor Ave, Philadelphia, PA  Zerand Department  An employee would operate the Ryobi 3,600 rpm bench grinder with the work rest not adjusted to within 1/8th inch of the abrasive wheel. The work rest was approximately ½ inch from the abrasive wheel. This hazard exposed the employee to struck-by/caught in-between hazards. This condition was observed on or about May 28, 2014.

29 CFR 1910.215(b)(9): Guard for abrasive wheel machine where the operator stands in front of the machine was not constructed so that the peripheral protecting member could be adjusted to the constantly decreasing diameter of the wheel:  a) 2155 E.  Castor Ave, Philadelphia, PA  Zerand Department  An employee would operate the Ryobi 3,600 rpm bench grinder which did not have the peripheral protecting member 1/4th inch from the abrasive wheel, exposing the employee to a struck-by hazard. The peripheral protecting member was approximately 2 inches from the abrasive wheel. This violation was observed on or about May 28, 2014.
