29 CFR 1910.134(d)(1)(iii): The employer did not identify and evaluate the respiratory hazard(s) in the workplace; including a reasonable estimate of employee exposures to respiratory hazards and identification of the contaminant's chemical state and physical form:    On or about June 3, 2014, and at times prior thereto, in the lumber storage building at Ken's Discount Building Materials, located at 1200 North West Avenue in El Dorado, Arkansas, an employee who was not using any form of respiratory protection, was enveloped in dust while repackaging split mortar bags and sweeping spilled mortar mix. The employer neither evaluated the hazard nor provided any type of respiratory protection. These conditions exposed employees to the hazard of inhaling silica dust.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:  On or about June 3, 2014, and at times prior thereto, at Ken's Discount Building Materials, located at 1200 North West Avenue in El Dorado, Arkansas, employees who had not been trained upon initial assignment to the task were repackaging split mortar bags and sweeping spilled mortar mix without appropriate personal protective equipment. These conditions exposed the employees to respiratory and chemical burn hazards.

29 CFR 1910.213(d)(1): Circular handfed crosscut table saw(s) were not guarded by an automatically adjusting hood which completely enclosed that portion of the saw above the table and above the material being cut:    On or about June 3, 2014, and at times prior thereto, employees in the lumber storage area, at Ken's Discount Building Materials, located at 1200 North West Avenue in El Dorado, Arkansas, were operating a Master Mechanic table saw Model number MJ10250VIII, serial number 2012/06/0103, that was not guarded. These conditions exposed the employees to the hazard of being caught in the un-guarded blade.

Fire extinguishers were available but their locations were not marked and access was blocked. These conditions exposed employees to the hazard of contact with flames, in the event of a fire, in the following instances:  a) Between Bays 2 and 3 of the lumber storage area b) The front of molding building c) The front of the dry wall storage building
