29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: a) The Color Shoppe, Inc. did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g) and (h) regarding labeling, maintenance of material safety data sheets, (MSDS) and training requirements will be met. Employees mix paints containing n-butyl acetate, xylene, n-butyl alcohol, ethyl benzene, naphtha, toluene, butan-1-ol. These chemicals can cause eye, nose, mouth and throat irritation. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1910.1200(h)(3)(iv): Employee training did not include the details of the hazard communication program, including an explanation of the labeling system and the safety data sheets, and how employees can obtain and use the appropriate hazard information: a) The Color Shoppe, Inc. did not provide training to employees by December 13, 2013 that included an explanation of the labeling system elements and the safety data sheet (SDS) format as required by the updated hazard communication standard. Employees mix paints containing n-butyl acetate, xylene, n-butyl alcohol, ethyl benzene, naphtha, toluene, butan-1-ol. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
