OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees were exposed to struck by and/or crushed by hazards in the event of a roll-over accident: On or about June 2, 2014, on the grass median along the northbound lanes of Interstate Highway 35E, near Exit 399-A, between the lanes of traffic and the frontage road, employees performing freeway mowing activities using Massey Ferguson tractors and mowing equipment were exposed to being struck by or crushed by the tractors and/or mowing equipment while performing mowing operations. (a) The employer did not document that tractors and/or mowing equipment were examined before being placed in service each day. (b) Tractors and attached equipment which were not safe to operate were not removed from service when they had defects such bald and worn steering tires. (d) The employer did not provide adequate training on the safe operation of the Massey Ferguson tractor and/or mowing equipment.
