29 CFR 1910.23(c)(1):  Every open-sided floor or platform 4 feet or more above adjacent floor or ground level was not guarded by a standard railing on all open sides except where there is entrance to a ramp, stairway, or fixed ladder:    a)  Grain Bin #1, north of the retail store.  On or about June 5, 2014, and at times prior thereto, employees were exposed to a fall of up to approximately 25 feet, as no fall arrest system of any other form of fall protection is provided, as they climbed on top of the bin to open and close the hatch door when using the portable auger.    b) Grain Bin #2, north of the retail store.  On or about June 5, 2014, and at times prior thereto, employees were exposed to a fall of up to approximately 25 feet, as no fall arrest system of any other form of fall protection is provided, as they climbed on top of the bin to open and close the hatch door when using the portable auger.

29 CFR 1910.27(b)(1)(ii):  The distance between rungs, cleats, and steps exceeded 12 inches:    a)  Grain Bin #1, north of the retail store.  On or about June 5, 2014, and at times prior thereto, employees were exposed to a fall of up to 20 feet, as there was a distance of approximately 15 inches between the rungs of the exterior fixed ladder, while they climbed to and from the top of the bin to open and close the door when using the portable auger.    b)  Grain Bin #2, north of the retail store.  On or about June 5, 2014, and at times prior thereto, employees were exposed to a fall of up to 20 feet, as there was a distance of approximately 15 inches between the rungs of the exterior fixed ladder, while they climbed to and from the top of the bin to open and close the door when using the portable auger.

On or about June 5, 2014, and at times prior thereto, employees were exposed to a fall of up to 20 feet, as the length of the rungs on the exterior fixed ladder was approximately 11 inches, while they climbed to and from the top of the bin to open and close the door when using the portable auger.  b)  Grain Bin #2, north of the retail store.  On or about June 5, 2014, and at times prior thereto, employees were exposed to a fall of up to 20 feet, as the length of the rungs on the exterior fixed ladder was approximately 11 inches, while they climbed to and from the top of the bin to open and close the door when using the portable auger.

On or about June 5, 2014, and at times prior thereto, employees were exposed to a fall of up to 20 feet, as there was a clearance of less than 7 inches from the rungs centerline to the bin in back of the ladder, while they climbed to and from the top of the bin to open and close the door when using the portable auger.  b)  Grain Bin #2, north of the retail store.  On or about June 5, 2014, and at times prior thereto, employees were exposed to a fall of up to 20 feet, as there was a clearance of less than 7 inches from the rungs centerline to the bin in back of the ladder, while they climbed to and from the top of the bin to open and close the door when using the portable auger.

29 CFR 1910.272(j)(1): The employer did not develop and implement a written housekeeping program that establishes the frequency and method(s) determined best to reduce accumulations of fugitive grain dust on ledges, floors, equipment, and other exposed surfaces:    On or about June, 5, 2014, and at times prior thereto, employees were exposed to fire and explosions from grain dust accumulation, as there is not a written housekeeping plan to address the cleaning of grain dust from exposed surfaces.
