TW Builders, Inc. jobsite located 16895 Oakmont Drive, Omaha, NE 68136: The employer is failing to ensure that an employee working on / with an unprotected side or edge was protected from falling by using guardrails, safety nets or personal fall arrest systems. An employee was observed working on the frame work of a gazebo being framed by the company; the employee was exposed to a fall of approximately 11 feet to the next lower level.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access. On the jobsite located at 16895 Oakmont Drive, Omaha, NE: The employer is failing to provide employees safe access to the top of frame section of a gazebo being constructed. The employer provided step ladders that were not of sufficient length to extend 3 feet beyond the level being accessed, the ladder being used was not secured at the top to prevent displacement and there was not a grasping device for employees to use while ascending and descending the step ladder.
