29 CFR 1910.95(g)(5)(i): The employer did not establish, within 6 months of an employee's first exposure at or above the action level, a valid baseline audiogram against which subsequent audiograms can be compared:  a.    An employee, working in the Picking Station, was exposed to a noise dose of 70.57%, or an equivalent dBA of 87.49 dBA, which is capable of causing permanent hearing loss. The sampling was conducted for 272 minutes during one work shift on June 5, 2014.  The employer had not provided him a baseline audiogram within 6 months of the employee's first exposure at or above the action level of 85 decibel.

On or about June 4, 2014, employees working in the Plant were provided baseline audiograms in May 15, 2012, however, the employer did not retain all required employee audiometric test records.

29 CFR 1910.95(i)(2)(ii): The employer did not ensure that hearing protectors are worn by any employee who is exposed to an 8-hour time-weighted average of 85 decibels or greater:  a.    An employee, working in the Observation Station, was exposed to a noise dose of 132.8%, or an equivalent dBA (decibels A scale) of 92.05 dBA, which is capable of causing permanent hearing loss. The noise sampling was conducted for 271 minutes during one work shift on June 5, 2014.   The employer did not ensure that the employee wore hearing protection when exposed to an 8-hour time-weighted average of 85 decibels or greater.

29 CFR 1910.1200(h)(3)(iv):   The details of the hazard communication program developed by the employer, did not include an explanation of the labels received on shipped containers and the workplace labeling system used by their employer; the safety data sheet, including the order of information and how employee could obtain and use the appropriate hazard information:  a.   On or about June 04, 2014, the employer did not provide the information and training on the new label elements and the new Safety Data Sheet format to employees who had exposure to hazardous materials such as but not limited to engine oil, motor oil, hydraulic fluid, transmission fluid, and diesel exhaust fluid.
