29 CFR 1926.451(b)(1): Platform(s) on all working levels of scaffolds, were not fully planked or decked between the front uprights and guardrail supports :  a)  At Lot 40 Cypress Pointe Auburn, Alabama:  On or about June 3, 2014 and at times prior; the employer failed to ensure the second level of a two buck high scaffold that his employees were working from was fully planked exposing employees to a fall hazard of 13.1 feet to the ground below.  b)  At Lot 40 Cypress Pointe Auburn, Alabama:  On or about June 3, 2014 and at times prior; the employer failed to ensure the first level of a two buck high scaffold that his employees were working from was fully planked exposing employees to a fall hazard of 7 feet to the ground below.

29 CFR 1926.451(c)(2)(ii): Unstable objects were used to support scaffolds or platform units:  a)  At Lot 40 Cypress Pointe Subdivision Auburn, Alabama:  On or about June 3, 2014 and at times prior; the employer failed to ensure scaffolding was set up on a stable object to prevent the scaffold from collapsing.  Each leg of the scaffolding was set up on mud sills and stacked bricks.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, sturcure, personnel hoist, or similar surface was not used.  Crossbraces were used as a means of access:  a) At Lot 40 Cypress Pointe Subdivision Auburn, Alabama:  On or about June 3, 2014 and at times prior; the employer failed to ensure employees installed and used a ladder to gain access to the first and second levels of the scaffold in use by employees exposing them to fall hazards.
