OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that the employer did not maintain a safe distance from the point of operation on the RG 100 hydraulic press brake exposing employees to struck by hazards from racks and its contents in the event of a collapse:     (a)Community Interiors, Inc. at 4545 East 60th Ave., Commerce City, CO 80022:  On and before June 6th, 2014, the employer did not ensure that the carpet storage racks were secured to the floor, and interlocked from front to back, to prevent the racks from overturning.  In addition, the storage racks on the north side included two bent uprights.  The condition exposed employees to struck-by hazards.    Abatement Note: Among other methods, feasible and acceptable abatement methods to correct this hazard are: 1.To follow MH 16.1: 2008 ANSI-RMI specification of the Design, Testing and Utilization of Industrial Steel Storage Racks 1.4.1 and 1.4.9 Upon any visible damage, the pertinent portions of the rack shall be unloaded immediately by the user until the damaged portion is repaired or replaced. Follow the manufacturer's recommendations for repairing or replacing damaged racking system.

29 CFR 1910.23(c)(1): Open-sided floors and/or platforms four feet or more above adjacent floor or ground level were not guarded with standard railings (or equivalent) and toe boards:    (a)Community Interiors, Inc. at 4545 East 60th Ave., Commerce City, CO 80022:  On and before June 6th, 2014, the employer did not ensure that employees were protected from fall hazards when working on the second floor mezzanine in the following instances:    1)The 8 foot wide hoisting area did not have guardrails where employees grabbed pallets of dried goods and pulled the pallets back onto the floor; and    2)The 86 inch high shelving on the north side served as guardrails. This shelving was connected to the floor via 3/8 tack-welding every 36 inches.  The shelving did not meet the standard strength and construction criteria for guardrails referenced in 29 CFR 1910.23(e)(3)(v)(b), to be able to withstand at least the minimum requirement of 200 pounds top rail pressure.      The condition exposed employees to fall hazards of approximately 11 feet.

The employer did not ensure employees had the proper personal protective equipment while performing carpet and pad cutting operations with knives without eye and hand protection, moving pallets of chemicals and flooring without the proper foot protection, and handling of carpet adhesives in that, skin and eye protection were not provided.       Abatement note: The employer shall verify that the required workplace hazard assessment has been performed through a written certification that shall include the following:       (1)        Identifies the workplace evaluated;   (2)        The person certifying that the evaluation has been performed;   (3)        The date(s) that the hazard assessment was performed; and   (4)        Which identifies the document as a certification of hazard assessment.

The employer operated two energized circuit breaker panels on the east wall, and one on the west wall, with only 30 inches of clearance to the storage racks.  The carpet rolls were arbitrarily stored on these racks and did not allow for the proper clearance around the breaker panels. The condition exposed employees to electrical shock hazards and fire hazards associated with 220 volts panels.
