OSH ACT of 1970 Section (5)(a)(1): OSH ACT of 1970 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: fall hazard hazards: (a) At the north side of the building ,an extension ladder utilized to gain access to an overhang was not erected properly. The side rails of the ladder extended one and a half rungs (18 inches) above the landing / access surface, observed on or about 6/10/2014. (b) At the site employee was exposed to a fall hazard ,in that, while holding items in his right hand, such as but not limited to, a thermos/cooler, he climbed an extension ladder up to a 15' parapet using his left hand.
