29 CFR 1926.404(b)(1)(i): Employer did not use either ground fault circuit interrupters as specified in paragraph (b)(1)(ii) of this section, or an assured equipment grounding conductor program as specified in paragraph (b)(1)(iii) of this section to protect employees on construction sites: a) On or about 06/10/14, in the brewhouse room of construction site of the Big Ditch Brewing Co., 55 E. Huron St., Buffalo, NY: A Milwaukee ½ Hammer Drill was used to drill holes in the wall for strips that hold conduit in place. The Hammer Drill was connected to 120 volt-ac power via an extension cord that was plugged into a receptacle on a temporary 4-receptacle outlet box. No GFCI or assured equipment grounding program was being used. NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.404(f)(6): The path to ground from circuits, equipment, or enclosures was not permanent and continuous: a) On or about 06/10/14, in the brewhouse room of construction site of the Big Ditch Brewing Co., 55 E. Huron St., Buffalo, NY: A Milwaukee ½ Hammer Drill was used to drill holes in the wall for strips that hold conduit in place. The Hammer Drill was connected to 120 volt-ac power via an extension cord that was plugged into a receptacle on a temporary 4-receptacle outlet box. The plug on the extension cord lacked a ground prong, AND two of the 4 receptacles in the outlet box (including the receptacle that the extension cord was plugged into) had an open ground . b) On or about 06/10/14, in the large room on the first floor at construction site of the Big Ditch Brewing Co., 55 E. Huron St., Buffalo, NY: A Milwaukee Portable Bandsaw was used to cut large conduit. The Bandsaw was connected to 120 volt-ac power via a short GFCI pigtail extension cord that was plugged into a receptacle on a 4-receptacle outlet box mounted on a steel column. The plug on the cord of the Bandsaw lacked a ground prong. NO ABATEMENT CERTIFICATION REQUIRED
