29 CFR 1926.95(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, and maintained in a sanitary and reliable condition wherever it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact: On or about June 11, 2014, and at times prior thereto, the employer did not ensure that the employees working on the construction site were wearing high visible vest while performing construction work around heavy earth moving equipment.

29 CFR 1926.602(a)(9)(ii): Earth moving or compacting equipment which had an obstructed view to the rear was operated in reverse gear; such equipment did not have in operation a reverse signal alarm distinguishable from the surrounding noise level or did an employee signaled that it is safe to do so. On or about June 11, 2014, and at times prior thereto, the employer did not ensure that the earth moving equipment in two instances was equipped with working reverse signal alarms distinguishable from the surrounding noise level, exposing employees to the hazard of being struck by the equipment. Instance a) The Volvo Wheel loader, model L60G back up alarm was not working. Instance b) The Caterpillar Model D8R Bulldozer back up alarm was not working.
