On or about June 11, 2014 at the worksite located at 392 Old Rockside Rd., Independence Ohio, the employer did not provide a means of egress by a stairway, ladder, or ramp for employees working in a trench approximately 11 ft. deep.

On or about June 11, 2014 at the worksite located at 392 Old Rockside Rd., Independence Ohio, the employer did not perform a daily inspection to determine the soil type so that adequate cave in protection could be utilized for employees working in a trench approximately 11 ft. deep.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c). On or about June 11, 2014 at the worksite located at 392 Old Rockside Rd., Independence Ohio, the employer did not provide adequate cave in protection for employees working in a trench approximately 11 ft. deep. The TY Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard CFR 1926.652(a)(1) which was contained in OSHA inspection number 315312736, citation number 1, item number 2 and was affirmed as a final order on 4/22/2011, with respect to a workplace located at 188 Cherry Ln., Parma, Ohio 44134.
