29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b).  The employer does not ensure that each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels is protected from falling.  This violation was observed on or about June 10, 2014 when employees were exposed to a fall hazard greater than 6 feet when performing decking work without a fall protection system.  Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure employees engaged in residential construction activities at heights of more than six feet are protected from falling.

29 CFR 1926.1053(b)(1): Where a portable ladder was used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder.  The employer does not ensure that the portable ladder used for access to an upper landing surface was secured at its top to a rigid support and/or a grasping device was provided to assist employees in mounting and dismounting the ladder. This violation was observed on or about June 10, 2014, at a residential construction site where an employee was exposed to a fall hazard when accessing the roof with a ladder whose side rails did not extend at least 3 feet above the landing surface, and the ladder was not secured at its top and/or a grab rail provided.   Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that the side rails on portable ladders used for access to an upper landing surface were extended at least 3 feet above the upper landing surface, or the ladder shall be secured at its top to a rigid support that will not deflect, and/or a grasping device will be provided to assist employees in mounting and dismounting the ladder.
