OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a hazardous confined space atmosphere. On or about June 11, 2014, at the silo construction site at the Louis Dreyfus Commodities Facility, the employer directed employees to conduct hot work (i.e. argon gas welding, grinding, torch cutting) within the silos (confined spaces) but did not evaluate the confined spaces for hazards including those changing conditions when hot work is introduced into the confined space.

29 CFR 1910.134(d)(1)(iii): The employer shall identify and evaluate the respiratory hazard(s) in the workplace; this evaluation shall include a reasonable estimate of employee exposures to respiratory hazard(s) and an identification of the contaminant's chemical state and physical form. Where the employer cannot identify or reasonably estimate the employee exposure, the employer shall consider the atmosphere to be IDLH. On or about 6/12/14, within the interior of the new silos (i.e. confined spaces) undergoing construction at the Louis Dreyfus Commodities Facility, the employer failed to identify and evaluate the atmospheric exposure for those employees conducting hot work.
