29 CFR 1926.251(a)(1): Rigging equipment for material handling was not inspected prior to use on each shift and as necessary during its use to ensure that it was safe: On 6/13/14, employees were using rigging equipment that had not been inspected for damage or the inspections had not identified damaged equipment and removed it from service in that: A. The hook connected to the Caterpillar 330C excavator was twisted and bent, and had been modified to remove the latch pin hole. B. The two leg chain sling used to pull the trench box had hooks that had been modified to remove the latch pin holes.

A) One employee was working in a 9' deep trench without a ladder. B) Three employees were working in a 6' deep trench without a ladder and in a location where the backfill and earthen materials were not sloped properly to allow workers to egress the trench excavation safely. Kruzcek Construction was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 952937, citation number 1, item number 1A and was affirmed as a final order on 4/23/14, with respect to a workplace located at North Overland Rd, Hobart, WI 54115.
