29 CFR 1910.178(a)(5): The powered industrial truck was equipped with front-end attachments other than factory installed attachments, however the employer did not request that the truck be marked to identify the attachments and show the approximate weight of the truck and attachment combination at maximum elevation with load laterally centered:    a. Tower Marine, Hyster Forklift, with no model number or serial number had a non-factory installed pintle hook attachment affixed to the front of the forklift lift body.  Forklift was not marked to identify approximate weight of the truck and attachment combination.  Attachment was used to move a trailer loaded with a 33 foot Chris-Craft recreational boat from storage to the launch area.     b. Tower Marine, Hustler Forklift, model # H-8000-B, S/N XK-89 had a non-factory installed trailer pin attachment affixed to the front of the forklift lift body.  Forklift was not marked to identify approximate weight of the truck and attachment combination. Attachment was used to move a hydraulic trailer loaded with a 30 foot Ericson Sailboat from storage to the launch area.

29 CFR 1910.178(l)(2)(ii): The employer did not ensure that each operator had successfully completed the training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace.  29 CFR 1910.178(l)(2)(ii) is applicable to shipyard employment by 29 CFR 1915.120 that incorporates the general industry requirements.    Tower Marine, employees required to operate forklifts were not provided training on the safe operation of forklifts that included formal instruction, practical training and an evaluation of the operators performance in the workplace.

29 CFR 1910.178(m)(3): Unauthorized personnel were permitted to ride on industrial truck(s):    Tower Marine, the employer allowed employees to ride on the side of a Hustler Forklift, model # H-8000-B, S/N XK-89, while the operator was pushing an empty boat trailer from the tower marine property up the hill to a heated storage building. Employees were exposed to crushing, struck by, struck against, caught between or caught under hazards.
