If such hazards are present, or likely to be present, the employer shall:  29 CFR 1910.132(d)(1)(i): Select, and have each affected employee use, the types of PPE that will protect the affected employee from the hazards identified in the hazard assessment;  a.  Located at the facility, the employer failed to adequately assess the workplace in order to determine if there were any hazards present, or likely to be present in which personal protective equipment would be required to be worn for employees being exposed or likely to be exposed to a serious hazard.  An adequate assessment would have identified the requirement for employees to wear foot and head protection when handling granite slabs.

An employee would guide a granite slab by hand without any means of head protection, thereby exposing the employee on the ground to a struck-by hazard.

The attachment was not secured to the forklift mast to prevent unintentional lifting or displacement on the forklift's forks, thereby exposing the employees to the hazards associated with forklift operation.

29 CFR 1910.305(e)(1): Cabinets, cutout boxes, fittings, boxes, and panelboard enclosures. Cabinets, cutout boxes, fittings, boxes, and panelboard enclosures in damp or wet locations shall be installed so as to prevent moisture or water from entering and accumulating within the enclosures and shall be mounted so there is at least 6.35-mm (0.25-in.) airspace between the enclosure and the wall or other supporting surface. However, nonmetallic enclosures may be installed without the airspace on a concrete, masonry, tile, or similar surface. The enclosures shall be weatherproof in wet locations.  a.  Located in the fabrication building, there were 240 volt electrical panelboard enclosures that were Type 1 enclosures which were not manufactured to be used in wet/damp locations, thereby exposing employees to fire or electrical shock hazards.   b.  Located in the fabrication building, there were 120 volt receptacle outlets and junction boxes that were not manufactured for wet/damp locations and had openings in the boxes that would not prevent moisture or water from entering the boxes, thereby exposing the employees to fire or electrical shock hazards.
