WORKSITE: The Werner 20 foot aluminum straight ladder, used by employees to access the front porch roof was not inspected by a competent person for damage or defects that could affect the safe use of the ladder.

29 CFR 1926.1053(b)(16): Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, shall either be immediately marked in a manner that readily identifies them as defective, or be tagged with "Do Not Use" or similar language, and shall be withdrawn from service until repaired.  WORKSITE: The Werner 20 foot aluminum straight ladder, used by employees to access the front porch roof had damaged and broken rungs and the ladder was not removed from service.

The program shall enable each employee to recognize hazards related to ladders and stairways, and shall train each employee in the procedures to be followed to minimize these hazards.  WORKSITE: The employees, using ladders to access the roof(s) were not provided with information and training in the hazards associated with the type(s) of ladders being used or the procedures necessary to eliminate or minimize those hazards.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.   WORKSITE: The employees, performing roofing activities on a 4/12 pitch porch roof and the 10/12 pitch main roof were not protected against the hazard of falling between 10-feet, 11 inches and 21-feet, 5 inches to the ground, respectively by the use of appropriate fall protection devices and/or systems.

WORKSITE: The employees, exposed to fall hazards while performing roofing activities were not provided with information and training in the hazards associated with falls and the procedures necessary to eliminate or minimize those hazards.   Xtreme Restoration & Waterproofing LLC was previously cited for a violation of this occupational safety and health standard (29 CFR1926.503(b)(1)), which was contained in OSHA inspection number 314962630, citation number 1, item number 1, affirmed as a final order on 6/15/2011, with respect to a workplace located at 67-69 South Main Street, Branford, CT 06405.
