29 CFR 1910.132(c): Personal protective equipment was not of safe design and construction for the work to be performed:    (a) On or about June 16, 2014, at 6512 N. Rock Garden Road, Parkville, Missouri, an employee was performing tree trimming operations and using a "buck strap", a metallic wire rope positioning device.  The use of the conductive positioning device was in close proximity of an energized power line resulted in the victim's electrocution.    NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM.  FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19

Rock Garden Road, Parkville, Missouri, a fatal accident occurred and a hazard assessment was not performed to identify the overhead power lines that were in close proximity of the work being performed.    NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1910.333(c)(3): Where overhead lines were to be deenergized, arrangements had not been made with the person or organization that operated or controlled the electric circuits involved to deenergize and ground them:    (a) On June 16, 2014, at 6512 N. Rock Garden Road, Parkville, Missouri, an employee was electrocuted while working in close proximity to power distribution lines energized to 7620 volts which were not de-energized or grounded by the organization that operated and controlled the electric circuits.        NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM.  FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19

29 CFR 1910.333(c)(3)(i)(A)(1): When an unqualified person was working in an elevated position near overhead lines with voltages to ground rated at 50 kV or below, the location was not such that the person and the longest conductive object he or she might use could come within 10 feet of an unguarded energized overhead line:    (a) On or about June 16, 2014, at 6512 N. Rock Garden Road., Parkville, Missouri, an employee was performing tree trimming work from an elevated position using a conductive "buck strap" within 10 feet of an energized power line.  He was electrocuted when his metallic "buck strap" contacted a power line energized to 7620 volts, 4 feet 6 inches from his work position.     NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM.  FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19
