29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:  a) Production Area: The employer had not established or implemented a written Hazard Communication program.  Employees were exposed to chemicals such as, but not limited to, Hardeners (methyl amyl ketone, n-butylacetate, xylene, ethylbenzene, isocyanates), Bases and Colors (ethylene glycol butyl ether, sec-butyl alcohol, barium sulfate, carbon black, titanium dioxide, graphite, aluminum oxide, methyl acetate, isopropyl alcohol, butan-2-ol, 2-butoxyethanol, magnesium fluoride, hydrodesulfurized heavy, acetone), Reducers (n-butylacetate, stoddard solvent), and Clear Coat (methyl amyl ketone, acetone, methyl acetate, methyl isoamyl ketone, xylene, methyl isobutyl ketone, ethylbenzene) while mixing in the mixing room and spraying in the paint booth.  Employees working in the Production Area were exposed tp chemicals such as, but not including glues.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:  a) Production Area: Employees were required to work with chemicals such as, but not limited to, Hardeners (methyl amyl ketone, n-butylacetate, xylene, ethylbenzene, isocyanates), Bases and Colors (ethylene glycol butyl ether, sec-butyl alcohol, barium sulfate, carbon black, titanium dioxide, graphite, aluminum oxide, methyl acetate, isopropyl alcohol, butan-2-ol, 2-butoxyethanol, magnesium fluoride, hydrodesulfurized heavy, acetone), Reducers (n-butylacetate, stoddard solvent), and Clear Coat (methyl amyl ketone, acetone, methyl acetate, methyl isoamyl ketone, xylene, methyl isobutyl ketone, ethylbenzene) while mixing in the mixing room and spraying in the paint booth. 29 CFR 1910.132(d)(2): The employer did not verify that the required workplace hazard assessment has been performed through a written certification which included the requirements as outlined in 29 CFR 1910.132(d)(2):  a) Production Area: The employer failed to verify, through a written certification, that the workplace assessment to determine the presence of hazards that would warrant the use of personal protective equipment had been performed.  Employees are exposed to isocyanates in hardeners while mixing batches of hardeners in the mixing room and spraying in the paint booths.  Employees are exposed to airborne, flying particulates while sanding car parts and blowing excess dust from the car parts in the body repair section.

29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:  The employer had not established or implemented a respiratory protection program for employees required to wear half-mask air purifying respirators and/or full-face supplied air respirators.  There was no written program, medical evaluations, fit-testing, or training on the actual respirators worn.  a) Production Area: Employees were required to wear P100 half-mask respirators including, but not limited to 3M 2097 respirator while performing activities that produce dust, such as sanding and blowing off the cars with an air gun.  b) Paint Booth: The employee was required to wear a Sata Vision 200 supplied air respirator while mixing chemicals containing isocyanates and spraying car parts with isocyanate-containing paints.
